Propriedade industrial e desenvolvimento tecnológico: um estudo aplicado as cultivares de arroz

Abstract

A existência da Propriedade Industrial tem como fundamento a concessão de um direito de exclusividade ao titular de uma nova tecnologia, condicionando-se esta diretamente à divulgação do modus operandi deste, ou seja, do segredo existente no invento. Assim, este trabalho objetiva analisar como o instituto da proteção de cultivares pode influenciar o desenvolvimento tecnológico de um setor específico do agronegócio: a cadeia do arroz. Ainda, o trabalho busca verificar se, no caso analisado, os fundamentos da proteção da Propriedade Industrial se mostram efetivamente realizáveis. Assim, aplica-se o método hipotético dedutivo, no qual se propõe como hipótese a assertiva de que a proteção dos Direitos de Propriedade Industrial aplicados às plantas pode promover o desenvolvimento de novas tecnologias e que isso resulta em benefícios para os stakeholders e para a sociedade.

The intellectual property base is the granting of an exclusive right to the holder of a new technology, but this is conditioned themselves directly to the disclosure of the inventions’ modus operandi. This study aims to analyze how the plant variety protection – a kind of intellectual property - can influence the technological development of a specific sector of agribusiness: the rice chain. Still, the work seeks to determine whether, in the case analyzed, the fundament of intellectual property is actually achievable. Thus, it applies the hypothetical deductive method, which proposes a hypothesis that the plant variety protection can promote the development of new technologies in this field and that will be result in benefits for stakeholders and for all the society.
